Voluntary Assumption of Risk & Total Customer Ownership
Water activities, giant wave pools, steep water slides, rain dance floors, and outdoor resort amenities inherently carry physical risks. Entry to the resort premises and usage of any amenity constitutes voluntary assumption of all risks and an explicit waiver of all legal and financial claims against Visava Resort, its owners, directors, and representatives.
1. Total Release of Liability: Accidents, Fractures, Injury or Death
Please read this non-negotiable legal condition before entering or participating in any recreational activity:
Zero Resort Ownership for Untoward Incidents
If any accident, collision, slip, trip, fall, bone fracture, body dislocation, muscle tear, laceration, head trauma, spinal trauma, drowning, permanent disability, or unfortunate death of any nature—whether minor, medium, or severe—occurs to any guest, minor, child, adult, or senior citizen within the resort property, swimming pools, slides, wave pool, rain dance floor, stairs, cottages, washrooms, or parking grounds:
THE RESORT & OWNERS WILL NOT OWN OR BEAR ANY LEGAL OR FINANCIAL LIABILITY
All responsibility, consequences, medical treatment costs, hospitalization expenses, and legal accountability rest TOTALLY AND EXCLUSIVELY WITH THE GUEST, THEIR FAMILY, ACCOMPANYING ADULTS, AND GROUP ORGANIZERS.
- Lifeguard Advisory: While certified lifeguards and security personnel are stationed to maintain order and provide immediate assistance, they do not replace parental supervision or personal care.
- No Negligence Claim: By purchasing a ticket or entering the gates, every guest explicitly indemnifies and holds completely harmless the resort owners, associates, and ground workers from any damage claims, police complaints, or compensation demands.
2. Health Conditions & Patients Warning: "DO NOT ENTER"
High water pressure, steep slide velocities, wave agitation, and intense sunlight are dangerous for individuals with pre-existing medical conditions:
If You Have Any Health Issues: Do Not Visit The Resort
Persons suffering from heart disease, high blood pressure, asthma, epilepsy, seizure history, recent surgeries, physical fractures, chronic neck/back pain, physical disability, skin diseases, infectious illnesses, psychiatric conditions, or pregnant women are STRONGLY ADVISED NOT TO COME TO THE RESORT and are STRICTLY BARRED from entering water slides and wave pools.
If a guest with known or undisclosed pre-existing illnesses visits the property and suffers any medical complication, stroke, cardiac arrest, respiratory crisis, or fatality, the resort, management, and owners shall hold ZERO responsibility. All medical and life risks are assumed completely by the guest and their attendants.
3. Room Allotment Disclaimer: Purely Availability-Based
- Availability Process: Cottage and room allotment operates strictly on a real-time availability and first-come, first-served process on the date of check-in.
- Specific Unit Requests: Prior requests for specific room numbers, garden units, or pool views are subject to actual ground readiness and cannot be legally guaranteed in advance.
- Force Majeure Allotment Changes: In the rare event of mechanical, air-conditioning, plumbing, or power issues in a particular room, management reserves the right to assign an equivalent alternate room or refund solely the room differential tariff.
4. Dynamic Pricing & Tariff Fluctuations
- Management Sole Decision: Tariff rates for one day picnic, night stay, food packages, and cottages fluctuate ("up and down") dynamically. All tariffs are decided exclusively by the resort management based on demand, weekend rush, seasons, and operational costs.
- Rate Validity: Rates quoted verbally or in previous marketing material are non-binding until an official booking confirmation voucher with token advance is issued by our official desk (+91 8007898267).
- No Historical Claim: Guests cannot insist on weekday pricing during festive holidays or historical rates from previous months.
5. Strict No Money Refund Disclaimer
Under NO conditions will any monetary refund or cash return be disbursed after payment. This holds true for any booking, irrespective of rain, sudden personal change of plans, traffic delays, vehicle breakdowns, or partial guest absenteeism.
6. Personal Belongings & Vehicle Disclaimer
Visava Resort provides parking spaces and guest lockers purely as an amenity. The management assumes zero liability for any theft, loss, breakage, water damage to mobile phones/cameras, or damage to personal vehicles parked inside or outside the premises. Guests are urged to safeguard all valuable ornaments, electronics, and cash personally.
